1. About these terms
These Terms of Service ("Terms") govern your use of the products and services provided by One More Turn Ventures LLC ("OMTV," "we," "our," "us"), including the One More AI Employee product and our website design and build services. By signing up for, purchasing, or using any of these services, you agree to these Terms. For website design and build projects, an individual written Proposal / Statement of Work ("SOW") also applies (see Section 7).
2. The One More AI Employee service
One More AI Employee is a subscription service that provides an AI-powered receptionist, chat agent, appointment booking, and review management for your business. Specific features depend on the tier you select.
3. Subscription and billing
- Subscriptions are billed monthly in advance via Stripe.
- You may cancel at any time; cancellation takes effect at the end of the current billing period.
- Failed payments trigger Stripe's standard retry process (~3 weeks). Repeated failure results in service suspension until resolved.
- Refunds are considered on a case-by-case basis. Contact us within 14 days of a charge you want reviewed.
4. Your responsibilities
- You agree to comply with all applicable laws, including the TCPA (Telephone Consumer Protection Act), HIPAA if applicable to your industry, and any state / local equivalents.
- You are responsible for the accuracy of information you provide — business name, calendar, services, hours, pricing — and for updating it as things change.
- You must not use the Service to harass, deceive, or defraud callers, or to conduct unlawful telemarketing.
- You are responsible for obtaining any consents required for call recording in your jurisdiction.
5. SMS / text messaging
SMS / MMS messaging is part of the Service. By signing up, by affirmatively agreeing during a sales or consultation call, or by explicit opt-in via webform or text keyword, you consent to receive text messages from OMTV related to the Service.
Types of messages. Messages may include: signup or checkout links sent after a consultation, onboarding notifications, billing or payment reminders, service / retention check-ins, account notifications, and prospect follow-up texts you have agreed to receive.
Consent paths. Consent is captured in one of three ways — verbal consent during a live phone call (call recording and transcript serve as the consent record), written consent at signup (transactional and service-related SMS only), or explicit opt-in via webform or text keyword. Full detail is in our Privacy Policy §6 (SMS / MMS messaging).
Frequency. Up to approximately 4 messages per month on an active account under normal use; up to 2 messages per month for prospect follow-up after a phone consultation.
Costs. Message and data rates may apply, per your mobile carrier.
Opting out. Reply STOP to any SMS to immediately unsubscribe. Reply HELP for support. STOP and HELP keywords are processed automatically by our carrier.
Data sharing restriction. SMS consent and mobile phone numbers collected through the Service are not shared with third parties for their marketing purposes and are not sold.
6. Data and privacy
Call transcripts, recordings, and contact details are stored and processed to deliver the Service. We do not sell your data. See our Privacy Policy for specifics on retention, access, and deletion.
7. Website design and build services
In addition to One More AI Employee, OMTV offers website design and build services. Each website project is governed by an individual written Proposal / Statement of Work ("SOW") that you and OMTV agree to. These Terms set the general framework; for a given project, where a signed SOW and these Terms conflict, the SOW controls.
Design and revisions. We deliver multiple design concepts on a private, password-protected preview link; you select one and provide a consolidated set of written feedback. Your SOW states how many revision rounds are included. A "round" is one consolidated set of feedback answered in a single pass — piecemeal feedback sent over several days may count as multiple rounds. Once you approve the final design in writing, the design phase is closed and further changes are handled as a paid change order.
Payment. Website projects are billed as set out in your SOW — typically a deposit to begin and the balance at launch. The deposit is non-refundable once the design concepts have been delivered. Your site goes live, and project files transfer to you, only after the final balance is paid in full. Overdue balances may accrue interest as stated in your SOW.
Content you provide. You are responsible for supplying the content needed to build your site — logo, images, text, and business details — and for providing it on time; missing content may pause the project and shift the launch date. You represent that you own or have the rights to all content you provide, and you grant OMTV a license to use, reproduce, and adapt that content solely to design, build, and host your site. You agree to indemnify and hold OMTV harmless from any third-party claim (including copyright, trademark, or right-of-publicity claims) arising out of content you supply.
Ownership. On receipt of final payment, you own the final website design and its content. OMTV retains ownership of the underlying tools, frameworks, templates, code libraries, and reusable components used to build the site, and grants you a license to use them as part of your site. For website deliverables, this section governs ownership in place of the general Intellectual Property section above.
Portfolio rights. Unless your SOW states otherwise, OMTV may identify you as a client and display the project — including screenshots, links, and a short description — in its portfolio, case studies, and marketing.
Hosting, domains, and care. Sites are typically deployed on Cloudflare Pages, and you own and pay for your own domain. Ongoing hosting, maintenance, and content edits are available under an optional monthly care plan described in your SOW; without a care plan, post-launch changes are billed on an ad-hoc basis. A live site's availability depends on third-party hosting, domain, and network providers whose performance is outside our control.
Third-party platforms. Websites may be built and hosted using third-party platforms and services (such as website builders, Cloudflare, and email-delivery providers). Your site's operation is also subject to those providers' terms.
Warranty and acceptance. We build your site to the scope in your SOW using reasonable professional care. After launch, we will correct defects in the delivered work for the period stated in your SOW; new features or changes outside the agreed scope are change orders. Except as expressly stated here or in your SOW, website services are provided "as is," without other warranties, to the maximum extent permitted by law.
8. Service availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. Underlying providers (GoHighLevel, Twilio, Stripe) may experience their own outages; these are outside our direct control.
9. Intellectual property
The Service — software, configurations, prompts — is owned by OMTV. Your business data, call transcripts, and customer lists remain yours. You grant us a license to process that data solely to deliver the Service.
10. Limitation of liability
To the maximum extent allowed by law, OMTV's liability for any claim related to the One More AI Employee Service is limited to the amount you paid us in the 3 months preceding the claim; for any claim related to a website design and build project, our liability is limited to the total fees you paid us for that project. We are not liable for indirect, consequential, or lost-profit damages.
11. Termination
We may suspend or terminate your account for serious breach of these Terms (including unlawful use, repeated failed payments, or abuse of the Service). You'll receive notice and a chance to cure where practical. Cancellation of a website design and build project is governed by your SOW, including the non-refundable deposit once the design concepts have been delivered.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email to the address on your account at least 14 days before taking effect.
